#3 It Was A Unanimous Decision

After committing forced oral rape on a girl who was so intoxicated she had to be carried to a car, a teenage boy was found not guilty. The official ruling was that "Forcible Sodomy cannot occur where a victim is so intoxicated as to be completely unconscious at the time of the sexual act of oral copulation."

#4 This Is What Happened During The Night Of The Oral Rape

The boy who was charged with sexual assault was 17 at the time when he gave a 16-year-old girl a ride home after the two had been drinking and smoking weed with friends at a park. After dropping the girl off at her grandmother's house, the girl woke up in hospital while she was being examined for sexual assault. The boys D.N.A. was found in and around the girl's mouth, although the girl cannot remember anything happening after leaving the park that night.

#5 It's A Difficult Decision

Since the girl cannot remember anything at the time of the rape, it's difficult to determine whether there was consent or not. The court's ruling was an 'unpublished decision,' meaning it can't be used as example to justify other court rulings in the future. Unfortunately, this isn't stopping other people from trying to use the ruling in this situation as an excuse to get away with similar crimes.

#6 Some Say The Ruling Was Appropriate

But if you look at the actual laws in Oklahoma, it seems as though the Judges were following their written laws to the letter. Legal experts say that under Oklahoma law, forced oral rape is only prohibited when the victim is unable to provide consent due to mental illness or disability. The law says nothing about intoxication or unconsciousness, so technically the judges were right.

#7 Everyone Is Scratching Their Heads

A lot of people are wondering just what in the hell the judges were thinking when they decided to make this decision. It seems to put the blame on the person who is being raped, not the people who are doing the raping.
